The legal troubles continue for Cedric Benson as he was arrested for drunk driving in Austin, Texas, according to the Austin American Statesman. Benson was reportedly stopped overnight at 5th and Colorado Streets for a traffic violation and refused a breathalyzer and blood test. Benson was arrested and taken to the Travis County Jail. He was released around 9 a.m this morning on bond, jail officials said.

Cedric Benson continues to take an aggressive approach to defending himself against charges of boating while intoxicated and resisting arrest, by hiring a new lawyer, who is considered to be one of Austin's finest, according to the Chicago Tribune. Lawyer Sam Bassett has already interviewed 10 people who were on Benson's boat Saturday night when Benson was arrested on Lake Travis, outside Austin, and described, according to a Lower Colorado River Authority police report, as being cocky, combative and smelling of alcohol. Bassett has scheduled additional interviews. Bassett stated, "I do not believe that Cedric was intoxicated when his boat was boarded by the LCRA officers for a safety inspection. I also am concerned that the force used by the LCRA officers, particularly the use of pepper spray, was not necessary under the circumstances." Another eyewitness has emerged to support Benson's claim that he was mistreated. Toby Patch was at nearby Emerald Point Marina on Saturday night when he states he saw police "manhandling" Benson after taking the running back off the boat and heading to a squad car. Patch was not one of the 15 people on the boat, but commented, "As they were taking him up the dock, they stopped, he said, 'I am fine, I can continue walking,' and they put their legs behind his knees and knocked him over his knees and started hog-carrying him. They ended up, I don't know why, but laid him on his back, I heard him say, 'Please don't pepper spray me, please don't pepper spray me. It was uncalled for, it was ludicrous, no point for it."

"I called my dad and told him, Call 911, my Black friend is getting beaten up by police on Lake Travis,' " said Elizabeth Cartwright, a friend from the University of Texas. "It's more what I heard than what I saw. I have never heard or seen Cedric that scared."

A woman who was a passenger in Cedric Benson's boat when he was pepper-sprayed and arrested Saturday night said the Chicago Bears running back did not seem intoxicated and did not resist arrest, according to ESPN. Elizabeth Cartwright, 22, a senior at the University of Texas and a friend of Benson, said she called her father and asked him to call police over the way Benson was treated by officers of the Lower Colorado River Authority, which patrols Lake Travis, a man-made lake northwest of Austin, Texas. Cartwright said she is willing to present her account of events as evidence. She also said her fiancée took photographs of the incident that help back up her claims.

Cedric Benson is offering a different view of Saturday's events. The running back tells NBC5.com that he wasn't drunk, his boat passed all tests, and he didn't have trouble with the sobriety tests. Benson says he counted forward and backward "at least 20 times." He adds that he never cursed or yelled, but the officer suddenly pepper-sprayed him. Benson explains that he was only dragged to the squad car because his feet were kicked out from under him. "I did nothing wrong; I didn't resist arrest, didn't curse and wasn't drunk," he notes. As we ponder the rushing attack in Chicago, thoughts shared by coach Lovie Smith, the team is putting action in motion by welcoming two potential draft picks into Chicago for personal workouts and interviews. University of Texas RB Jamaal Charles and Tulane RB Matt Forte have spent time with Smith and his coaching staff in an effort to evaluate their potential employment with the Bears, according to ProFootballTalk.com. Rumors also indicate the team is interested in meeting with University of Arkansas RB Felix Jones. Those names suggest the Bears are looking to use a later pick, namely their 2nd- or 3rd-round selections, to add such a player. Cedric Benson has been rather disappointing (another in a long line of failed experiments by Bears management, strongly believed to be the final decision makers in many of these picks rather than putting such responsibility solely in the hands of the coach), and Smith seems all too happy to consider introducing options and competition to the position. Of course, speculation will revolve around their first pick of the draft, 14th overall. The team has a laundry list of needs and great intrigue revolves around that decision. Stay tuned.

Lovie Smith called running back Cedric Benson a hard worker, but indicated he would like to see him lose weight in an effort to gain quickness, according to the Chicago Tribune. While being clear he was not laying all the blame on Benson, Smith said he does not want to see the same player he saw in 2007. "You look at some of those things and change your body up," Smith said. "You maybe play at a lighter weight. You do some things differently." Smith said he believes Benson is very motivated in part because of the way last season went for him, and that it's time for him to live up to expectations. "There comes a time when you need to produce," Smith said. "That's where he is. It's as simple as that." Benson continues to rehab from a broken leg and should be ready to participate in the off-season program at some point. Smith also made mention that there are a lot of good running backs coming out in this class, and the Bears have been rumored to be selecting one of them in the 2008 NFL Draft.

Lovie Smith had lunch with Arkansas rushers Darren McFadden and Felix Jones on Monday, and the team will reportedly scout the Razorbacks' pro day. The interest in their backs could mean that Benson's rehab from a fractured left ankle is behind schedule and that he is possibly being phased out of their plans.

Chicago is being extremely tight-lipped regarding Benson’s rehabilitation. Benson has reportedly been a regular at Halas Hall this offseason, but team insiders haven’t actually seen him working out. The true verdict on Benson will remain out until he actually tests the ankle for the first time in training camp. Benson, who has pocketed nearly $14 million during his three-year career, is scheduled to cost the organization $3.35 million this season. The lethargic Benson can’t afford to lose any speed, and the organization has already stated he will have to earn the starting role this year. This report coupled with previous poor performance makes him a very risky fantasy player in 2008.

Furthering a previous report, Cedric Benson will not simply be handed the reigns to the Bears RB position in 2008, he will have to earn it according to a report at the Houston Chronicle. "Right now it would be hard for me to say many guys are No. 1 at their position," HC Lovie Smith said. "We know more about Cedric right now in that lead position. He didn't have a good year, and there are reasons why, from the injuries and just his overall play wasn't what we would like for it to be this past season." Given the fact that he is currently rehabbing from a severe broken leg, Benson better impress the brass with some diligent work this off-season as it's clear that this will likely be the make or break season of his career.

General manager Jerry Angelo has vowed to bring in some competition for Benson and build the offense. The report mentions that believing this kind of talk from Angelo is difficult to buy due to the money it would take to sign another high profile young running back.
